Default Fence requirement for retention pond in Durham

Hello everyone,

I have searched the forums and could not find an answer to this. I also did a bit of looking on the Durham city website but could not find any guidelines regarding this. My neighbor and I are interested to know if there is a city requirement, as she had someone out to give an estimate for building a fence for her backyard and he mentioned that the retention pond near us (which is hideous) is required to have a fence around it. Anyone know if there is any truth to this? Thanks!

There is no requirement by the city or county for the retention pond to have a fence

i thought it was a Federal requirement to have a fence around the pond.

My neighborhood (not in Durham) has just been through this regarding a retention pond we have. Some neighbors demanded it be fenced in, claiming it's a hazard to children. Others say it's no more a hazard than any naturally occurring pond, and they don't want to pay for a fence. So we got the town out to inspect and advise (actually 3 different representatives). Their recommendation? (1) fencing is not required; (2) fencing actually creates a greater hazard for children than not - some children will be inclined to climb the fence to explore what's off limits; and (3) because it is a stormwater retention basin, access to it must be maintained for heavy equipment access required for maintenance and sediment cleanout.

I'm not trying to debate those points - just relaying what we were told.

I'm fairly certain that the federal govenrment does no mandate fence construction on private property. They do however, mandate the construction and maintenance of stormwater management ponds.

The local and county governments do not mandate fencing around stormwater ponds. It's the decision of the entitiy that is responsible for the operation and maintenance of the pond.

yes, Fedl Govt has no such requiremetn.
the requirement is for the retention pond.
I was wrong.

I have seen storm water run off ponds in Durham that are not fenced in. There is one on Herndon Rd....it's part of the shopping center that has Moe's & REI.
