I'm sorry you're going through this. I would venture to guess a contractor conducting business like this has some kind of "track record" somewhere. You may be able to find other dissatisfied customers just by googling the information you do have. As mentioned, there is no guarantee you will get paid even if you get a judgment in your favor. That shouldn't necessarily stop you from trying. Crooks make it hard for the rest of us and they need to be stopped (or at least paused).

All the best to you.

D/B/A is a standard abbreviation for Doing Business As. It is a legitimate use of an assumed name. A resident may register an assumed name for business purposes, provided nobody else is already using that name in the same county.

Suppose you want to begin a business in Wake County.
Go to ... Wake County Assumed Name Search
and search on the first word in your proposed business name.

Search on superior ...

1) You will see the business name Superior Plumbers is still available. For a small fee you may register that assumed name and have exclusive use of it within Wake County.

2) You will see the business name Superior Printers is already taken, and you may click on a button to view the Certificate of Assumed Name or Partnership which discloses the name and address of the principals.

If you file a claim against a large corporation with offices/ operations all over the planet, are you required to file only in the county where the HQ is located? That probably defeats the purpose of a consumer managed low cost litigation approach unless the defendant happens to live in the same county.

LANC - Small Claims Booklet - Ch. 2

Where to Sue

If you are suing someone who lives in your own county, start the lawsuit there. If you are suing someone in a different county, you must start the lawsuit in that county.

HI,

I've read through the link above and done some light searching on Google but... I would like to start a claim against a company HQ'd in another state but with a local office for failure to provide a service in small claims court.

Is this something that would have to be filed in the state/county of the corporate office?

Thanks

One different option not yet discussed is to file a homeowners insurance claim. I did that once for a contractor who messed up my driveway causing thousands in damage for a $1200 concrete pad job. Insurance paid me and went after him separately. NOTE: I'm not a lawyer and I can't say if/how this would affect premiums, if at all, but it didn't affect either my premium or my insurability rating/score.
