The City of Durham has claimed immunity and is placing all blame on Nifong, jerk that he is. $30 mil each is a bit steep for these guys. I agree they deserve a payout b/c their lives were screwed up royally by Nifong, but I think a more reasonable settlement could be reached.
I, too, was baffled at his getting re-elected during all of this mess.
I too couldn't believe that he was elected in the midst of it all. What were the residents thinking? Truly, I would like to hear that point of view if anyone wants to weigh in on that side of things.
I agree that the $90 million is a little extreme, but isn't it more to prove a point? It's my understanding that you rarely ever collect the entire amount of these outrageous settlements. If nothing else, the judgment would follow him around for the rest of his life....every time he applied for credit...or a background check was conducted...just a little nudging reminder.
I believe the City of Durham has an insurance policy that covers them up to $5 million per incident. So, its possible that the city could somehow be found negligent and thus have to cough up some dough. I'd imagine that if it came to that, $5 mil. per player would be accepted by the plaintiffs.
