When I had the experience with the $15 dollar license plate light bulb, they didn't ask. They had already done it and presented me with the bill plus labor(!). I guess I could have asked them to remove it and refused to pay, but I just marked it down as a lesson learned and we don't ever take our vehicles back to that place any more. They were also rude to me on the phone when I called to make an appointment. I wanted to go there because it was conveniently located but never again. We've got some good fellas who do it for us now and they would never charge more than a buck or two for something like that. They value our repeat business too much.

1 - will it be flagged in a computer system as failing? (Might lead to the second station also trying to upsell me.)

2 - is it legit to charge me for the failure notice to begin with?

Thanks
There was a time when a well placed 10$ and a fresh home grown watermelon would pass any vehicle..

But yeah, seriously, take it to the test only station. Good luck!

If the brakes are truly spongy, then the OP could take his/her chances and shop around at different inspection stations, or he/she could just take the extra few minutes and have their brakes looked at (they are slightly important).

Exactly. I could care less if your car has an issue that only affected you. Problem is when there is an issue with BRAKES it will be me you slam into because you thought your car was fine.
