The technician should have placed a call to Duke Energy when the neighbor alerted him that you were still on the property, and they (Duke Energy) should have called you to inquire. If they couldn't reach you, fine - shut it off. But to just completely dismiss the neighbor without any follow-up, sounds like the tech was being lazy and didn't want to put forth a little extra effort to ensure the job was done properly.

Alternately, the neighbor could have called you right there and handed the phone to the tech, so that you could have stopped him.

He probably had dozens of work orders to carry out that day and it's not his job to question them. The OP was clearly at fault and not Duke Energy or their technician who did what he was ordered by his employer to do.

Disagree. If you were that technician, and you showed up to one of these work orders, and a neighbor intercepted you and informed you that the people were still occupying the residence until the following day, would you just ignore the person and shut off the power anyway? Probably not. You would place a call to your boss and tell them what was going on. Shutting off people's power, in winter, is a big deal. I think the technician ignoring the neighbor was due to laziness and not giving a sh*t. Just my opinion.

the only fact we know is that the cutoff order was made for Monday, and executed on Monday. and that, for better or for worse, the OP knew he should have changed the order, or been present on Monday to ask the tech not to cut it off.

According to the not so nice lady I talked to at Duke, even if we were home he would have cut it off.

That would have been a fun time.
