Neighbor recently landscaped and built a pool next door, our home is on a downward grade and also has a pool. The landscaping from the neighbor involved redirecting the flow of water to divert and increase the natural flow to our property. We also have a pool of which has been filled with muddy water for the second time since the upper neighbor built the pool. We have also had severe flooding and water damage to our property. The neighbor was notified during the original construction as well as after completion of the damage even to to point of helping with the flood waters at one point. Now almost a year later, problem still exists, the neighbor will not acknowledge the problem and the flooding is worsening. Anyone have ideas?

Are you in HOA? I had a friend with a similar problem. HOA board came out when it was raining, walked around in mud up to their ankles, and told the offending neighbor to remedy the problem (my friend had already tried to deal with the neighbor on her own).

Do you know the company that did the landscape for them? Sadly, since people can be selfish trolls, you're probably going to have to seek legal counsel to get things repaired. If you have not documented your troubles with photos, dates of flooding, dates you spoke to neighbor about concerns, their reactions/comments/actions - you should start that ASAP. Really unfortunate situation, good luck with resolution. Hope your neighbor comes around.

I'd start by contacting the building inspector for whatever locality you are in.

It's crazy the amount of run off planning and enforcement there is on a new development. But when it comes to keeping things in check the planning and enforcement people are worthless.

You will get no where with the gov't unless you are calling and emailing 2-3 times a week and leaving voicemails and emails. It might take months/years to get them to look into the issue.
