Ok, that is nuts. I had no idea.

However, Mr Davenport bought in 1998. Didn’t they back then? I bought around that time, and I don’t remember it being optional.

Not true. Real estate agents started around the year 1900.

A good agent would advise them to get one anyway. An inspection is not required, but highly recommended. In the end it would still be up to the buyer.

Right, so either this guy paid cash and didn’t get a survey, which honestly would be a little hard to believe as I recall it being pretty standard practice at that time, or he had it surveyed because he got a loan and therefore could not claim ignorance about the driveway being on Ms. Tyson’s property.

Either way, it sounds like it was pretty common knowledge in the area at some point that there was an issue with the driveways as other folks moved their driveways over, and yet he decided to pave his.

And that gigantic landscaped hedgerow that he admits to knowingly planting on her property and seems to clearly encroach is sort of telling.

I didn't say there was no such thing as "real estate agents"....but up until the 1990s' there was no such thing as "buyer agency"...

Everyone worked for the seller. An agent's job was to get a house sold and they technically always represented the seller; there was no buyer representation at that time.

I just remembered that the house I grew up in had a shared driveway that went between our house and our neighbor’s house and lead to garages on each property. Maybe Mr. Davenport could just share.

I suspect that money will cross hands and Mr. Davenport will get a new curb cut and driveway out of the deal.
