The snake in question is definitely not a garter snake. That much is easy. It is also definitely not a copperhead. So relax, it is not poisonous. Beyond that, it is difficult to positively identify the species just from your picture. But it will not hurt you. If you just ignore it, it will go away. It will not attack you or your children. The pests it eats are definitely more bothersome.

It has the pattern of a garter snake, but the color is more reddish than is usual. But snakes do have variety in coloration. It's definitely not a copperhead or any other poisonous snake. It will not bother you if you don't bother it. It will eat mice and voles and other pests.

But more importantly, it is a beautiful part of God's creation. I would never kill a non-poisonous snake. I consider it a great privilege to see such a fascinating creature, and a great privilege to live with nature, not against it.
