I believe this is how Hope Valley got its name:

New Hope Valley Railway & NC Railroad Museum

It's a reference to a NC river and, subsequently, a railroad with a stop near the development. I'm no expert on these things, but given its geographic/historical significance, it doesn't seem like any one neighborhood should have exclusive rights to the name. It's not a brand, it's history.

They can't trademark "Hope Valley" in relation to any use of the name but they could trademark the use of Hope Valley in relation to a a residential development in southwest Durham.

Similarly, the Fearrington name dates back over 200 years but if I tried to open a restaurant in Chatham County named "The Fearrington Restaurant" then Fearrington House Restaurant would sue me and would likely win.

Hehe. That one was so pretty! I tried to get it from two diff angles b/c of the huge tree in the front and that was the best shot. The other half (hidden by the tree) looks gorgeous as well. You can barely see the dormer above the garage.
