Default were any agents/brokers ever fined for DO NOT CALL?

Are there any cases, active, pending or closed where agents were fined for the DO NOT CALL violations?

Well, these are mortgage lenders, not real estate brokers, but somebody is being fined for it (http://originatortimes.com/content/templates/standard.aspx?articleid=1731&zoneid=5 - broken link).

Are you just curious? Or, are you getting calls from an agent(s) about your home?

Something is wrong when politicians have a different set of rules vs. the buiseness.
In my area, only about 10% of all numbers are non DNC.

Have to think of a survey or a politican I want to support I guess.

You do realize that you can get in at least equally big trouble for using politics or a survey as a cover for soliciting business in order to get around the do not call list, don't you? And, believe me, people DO turn them in - it's so incredibly easy to do so.

in all honesty, DNC laws are probably never followed to a "T".
check this out... your former client calls you and tells you to call Bobby, since Bobby is interested in selling their home and is waiting for your call.

Bobby is on the DNC list.

Do you call Bobby?
If so, you risk the fine.

But something tells me you are calling anyway...

Am I wrong?

Hmm.. good one.. but.. if Bobby is waiting for my call, isn't that in essence 'approving' my calling him? Why would Bobby be waiting for my call unless he had given the OK to the referring former client?

Or, are they both in cahoots to get me fined?! lol

Well, legally, calling Bobby is forbidden by the DNC, because you don't have a prior relationship with Bobby and Bobby is on the DNC list. But I'd say calling Bobby is safest since there is a presumption that your former client is not lying, therefore, Bobby will not even think of reporting you.

But... if someone reported the call, that would be a violation.

Presumption of approval is not the same as approval, I guess.

But what do I know? I'm not a lawyer nor giving legal advice. I don't even know how play one on TV.
