Thanks for the "help." I guess you know more than NRT/Realogy which has gone to the expense of maintaining this list on its Intranet and trains all of its agents on how to follow the law.
Your list that you provided
Because of limitations in the jurisdiction of the FTC and FCC, calls from or on behalf of political organizations, charities, and telephone surveyors would still be permitted, as would calls from companies with which you have an existing business relationship, or those to whom you’ve provided express agreement in writing to receive their calls.
Is a list of telemarketers who CAN call.. it does not list people, not one, who is not a telemarketer because the law (16 CFR 310.4(b)(1)(iii)) applies to telemarketers. http://www.ftc.gov/os/2004/11/041112tsrfrn.pdf for the actual law

I wasn't aware that real estate agents were political organizations, charities or telephone surveyors. I'm not going to waste any more time debating this with you, unless the consumer has an existing business relationship (up to 18 months) or has provided written consent, they cannot be called.
I called the Do Not Call registry myself, just now.
It's not easy to get through to a live person there!!!

Situation described to FTC:
- Person had home on the market, is now getting phone calls from real estate companies/agents with whom they had no previous business relationship.
Verdict from FTC:
- It is not OK for real estate companies/agents to cold-call people with whom they have no previous business relationship. This falls under the "no telemarketing" rule. I was referred to following document: You Make the Call: The FTC's New Telemarketing Sales Rule
Solution recommended by FTC:
- Person should file a complaint.

I believe some states terminate your RE license upon violation, so you might want to take a look at your state's laws. You may not be as nonchalant if you find that your license could go bye-bye.
Sellers, if you don't calls coming in when your listing expires have the agent add that to the remarks section so that it doesn't happen.
It is rude and discourteous to call at 7 am or knock on a door at 8 am or even to call late at night. People should have more common sense but sometimes they don't Just don't judge the whole industry by those very few without.

I stand corrected, but I still cant see how that would be true considering that the law only applies to telemarketers.. Perhapse they redefined what "telemarketers" means.. it wont be the first time.

"The business or practice of marketing goods or services by telephone."
since realtors are not in the BUSINESS of marketing goods or services by telephone.. its not quite telemarketing..
guess it depends on your dictionary.
Are they not marketing their services to sell your home? I know the ones that called me didn't call just to say hi . They were selling their services to sell my house.
