Sorry, but that isn't always true, either. In Idaho, the seller's agent is not only not required to answer, they are prohibited from answering unless they have written permission from the seller. Even then, the seller is allowed to refuse to answer. They can't lie, but they can refuse to say either way.
Of course if the seller says "I won't answer that", that is an obvious sign that if it matters to you, you'd better do some more research.
Not always true de jure, but in the end, de facto, it works.
I agree with your point. "I won't answer that," may reasonably be construed as affirmative.
