I have a client who is here from Mexico. He has a visa that doesn't expire until 2014. He has a bank account, cell phone, and he is paid on the books for his job, which I verified. Says he needs a 2 bedroom for him and his brother. His brother is here illegally.

So he is been pressing hard for this one apartment. The listing agent finally got back to me and said this client had contacted her on his own about renting previously and indicated 6 people would be staying there. I have asked him 4 times already how many people would be in the apartment and he said just him and his brother.

Would you even bother with this client? Most landlords want a credit check anyway and can't run one on him without the social security #.

If he is paid on the book, he has a SSN or at least a Tax ID #. Anyone with a work visa and pays taxes will have a number used for tax purposes.

Big difference between 6 people and 2.

Everybody that legally has taxes to pay in the US gets something that looks like a SS #, if they are not eligible for a real SS number they get an ITIN: TIN numbers for Tax purpose, ITIN number

Tell him that every adult must be checked and their names must go on the Lease. (That is our policy, hopefully yours, too) Take his application and tell him when he returns with everyone else's application you'll process it. If he is working and paying taxes then he has some kind of number. Insist on seeing a pay stub because that's the only way to be sure.

In general you should have clearly understood application policies that you follow with EVERY applicant. I have an "information sheet" that I hand out with every application where our policies are listed, along with some other helpful information about renting from us. They either follow the guidelines or look elsewhere.

He might be working but the social number he is using might not be his. There are quite a few companies that are resisting the E-verify program. While it is not perfect, it does sort out the obvious fraud cases.

By the way I was thinking about this. If he has a bank account, he certainly has some kind of number because I don't think one can open up a bank account without something. We have foreign owners w/ local bank accounts and they have to get a Fed ID Number so we can report their income.

And, when someone "presses hard" for a rental that's a red flag especially combined with his stories that aren't lining up.

Thanks for everyone's input. I was able to obtain a bank statement from the brother to help verify his income and finances. Looks like I have a landlord willing to rent to them. Both brothers will be on the lease. I told him that if anyone else is going to live there, he must be put on the lease. Landlord said if they add a 3rd person to the lease, they have to pay an extra $200 a month (ended up finding them a 3bedroom apartment). Landlord also wants 2 month's security, so I think thats fair.
