Can I change realtor's - short sale approval help -
Hello,
I am doing a short sale on my condo and since the moment we signed our listing agreement with our agent she became a total nightmare. She is so rude and now is totally throwing us under the bus and I can't take it anymore.
We have had 3 offers and two backed out so now the final offer was good and then I got an approval from the bank in a total of 3 weeks time (yes). So we are sitting here with an approval from the bank and our realtor has sabotaged our deal and it not working for us but against us. At this point the deal with the buyer we had is off because she made them so mad. This is the second time this has happened. Her boss is not that helpful either so here is the question.
Can we switch realtors without totally messing up our approval from the bank what should we do. We CANNOT continue to work with her.

How is she working against you? How is she sabotaging you?
The bank approval is irrelevant to who your Realtor is. Does your contract allow you fire her?

I don't see in the contract anywhere that talks about me getting out but there is a part stating that she can cancel anytime.
There are so many things she is doing and is causing so much uneccesary stress in the situation. Honestly I am not going to continue to speak about her it's exausting, I want to forget it and move on.
What protection do I need to get out, she is being so vindictive that I feel I have to contact the bank to remove authorization to speak to her because she is so evil she would call them and sabotage us.
I don't even want her sending buyers our way once we are done with this.

In most listing agreements there is a discussion of the brokers responsibilities/obligations. Probably a simple statement like "Broker will make diligent and continued efforts to sell the property". I don't think sabotage of a sale fits that statement.
Since the listing agreement is a contract, if you wish to cancel the contract for cause, you should speak to an attorney.
It does not make sense that a real estate agent or their broker would sabotage a closing, I guess there is part of the story that is missing.

I wouldn't tell the agent what's going on.
If your agent is acting like an a$$ she may demand that you pay a commission for the sale you're doing. Legally she may have a right to a commission (I don't know if she does). If a nonrelative bought your home during the listing period and then sold it after the listing expires then you would owe your agent a commission.
Just let the listing expire, and suck it up with your agent for a little while longer.

You should check with an attorney and mention that to him/her. One party to a contract with the ability to pull out at any time while the other cannot causes all sorts of issues. Sometimes that can mean that the contract is not really a legally binding and enforceable contract. I'm not saying that's always the case, but it may help you in this situation.

If you're not going to tell us what the Realtor is doing to sabotage your deal, we can't help you. There's a ton of good info available here, but your story sounds very one-sided right now.

I would encourage you to talk to the realtors Principal Broker. The PB will most likely keep you in contract to the company but may give you another realtor.

First, document EVERYTHING, dates and times and try and correspond with your agent through email and save the emails. Hire an attorney and have them draw a letter to the head broker of the agency and request that they let you out of the contract. If they refuse, tell them you intend to report the realtor on ethics violations with the state.
