A contract is bound by both parties, and can terminate if both parties agree.

A contract cannot terminate unilaterally.

An attorney would know that.

Talk to the Designated or Managing Broker on Monday. I'm sure there are laws in that state about the timely handling of deposits and it looks like that wasn't done. A potential complaint to that state's Real Estate Commission will get you an audience (and most likely your release in writing).

We received our earnest $ back yesterday. No Official document of termination yet though. Found a new agent that we LOVE. I am keeping him up to date on everything along with giving him copies of correspondence with the other agency to help cover his you know what until we get the proper document from them.
Thank you all so much for your advice!

We are now focusing our search in a totally new direction...
Anyone have an opinion on Youngsville NC? Saw a few possibilities, a little further commute than I'd like but alot of home/property for the dollar.

What do you think about growth potential in the area/ Good investment or look elsewhere?
