If you were in CA and you knew for sure, I would say yes. If the guy down the street runs a car repair shop in his garage that makes a lot of noise during the day, yes. Once again, it's not automatic that you did something wrong, but you don't want to give the lawyers something to argue, because win or lose, you lose.
