Hmmm, good point. He tried to email a cancellation form twice...didn't ever come through, not even in my junk mail. I let him know it didn't come through. I gave up because obviously the guy is having technical problems...OR not? You don't think he wouldn't send it on purpose, do you?
I have a email confirming he would cancel the listing and no commission would be owed unless the buyer was procured by him prior to my canceling the listing.
Have you called the agent and asked him about this? There are so many options.
Without knowing the ins and outs of your contract, I would:
1. Call the realtor and ask him about this status.
2. Tell him to mail you - snail mail - the listing cancellation form. Tell him that you expect to receive it within 5 days and if it's not here by then, you will unfortunately need to be contacting his broker to get him/her to email r mail it to you since apparently for whatever reasons this just can't be accomplished through the former realtor - and you really don't want to do that.
Prior to this snafu, apparently you were on good terms with this realtor, so rather than assuming the worst, maybe you should just pick up the phone and call him and get some clarification.

The email "trail" he was told to terminate the contract and did without any repercussions, now I find out he didn't "cancel" the listing on the MLS. It should be corrected by tomorrow, if not yes I will contact the broker he hangs his license under.
In Idaho, when you sign a listing agreement, it is a contract and if you take it off early, the brokers have the right to keep it withdrawn instead of cancelled. If it is withdrawn, you can sell it yourself, but if it to someone the broker showed it too, then you are liable for commission.
Also, if you want to cancel a contract early, 95% requires a termination form. If you want it done, I would go to your agents office and sign it. I highly doubt docusign was f#cked up for a week. It's a great tool and I work in the software industry, no way they are not going to deliver for a week...that would KILL their business.
Any way, if it's not changed by tomorrow I will contact the head broker...no since wasting time with an agent trying to find a loophole....I don't play games.

Why do we have to babysit our Realtors?
Interesting. After our listing expired we asked them to remove the sign and broker made us come in and sign a termination of listing paper. That seemed strange to me because the listing was an expired listing. Then it did not get on the expired listing list for almost two months.
I would definitely get a cancellation signed. Go to his office and meet him to sign it if necessary.
To me, taking the home off the market is a different animal than cancelling the listing. Be perfectly clear. Get the paperwork signed.
