I'm curious too how your realtor had power to act on your behave regarding funding the loan. You may need to complain to the local board of realtors and the state corporation office which is sometimes in the Sect. of State's office.

Otherwise, in this situation you sue the seller. If the seller wants, he sues the movers. But the movers were hired by him, not you. Your problem is with the seller.

In all the homes we've bought or sold, we had to do the final walk through and give the approval before the closing could be initiated.

It sounds like they *did* the final walk-through the day before, and just left it up to the sellers and their own agent to make sure everything was cleared out, without demanding another walk-through before closing. Otherwise, what they were doing at their storage unit during closing??? How did the agent go ahead with the closing without both parties present?

Anyway, I don't know how they go back to the sellers now, since they've already allowed the movers to try to fix the damage. Now the sellers can say it's no longer their responsibility and they're not going to pay for damage caused by the person hired by the movers.

When I sell, I won't close unless every last thing is cleared out. My last house, the old guy tried to leave his old rusting metal trash cans, a pile of dead tree branches, and old expired fire extinguishers in the basement. (He had tried to pull some other shady stuff on me so I was not about to overlook anything for the sake of closing.) I held up closing until I got in writing that his son would come back and get everything out. I'm sure he thought I was a jerk but I didn't care -- why should I have to get rid of his old crap? I got stuck one time with a sellers' old paint cans (I hated their colors and repainted the whole house) so each time I have moved, I've gotten more and more strict about NOTHING being left behind.

BTW, I have used Two Men and a Truck in the Philadelphia suburbs (they had been recommended by an agent) and they were very careful, so I don't think you can disparage the whole company because of this incident.
