Honestly, I wouldn't do anything that involves money at this point. Have the conversation, write the letter, save the copy.


That should (hopefully) prevent them from eventually legally usurping your land by their unlawful, unchallenged use of it.

Then I would have a surveyor put that missing rod back where it belongs and I would tell the neighbor he can pay for the survey or you'll see him in small claims court. And then follow through. I noticed some people are advising that you tell the neighbor that you're going to put up a fence even if you don't intend to. That's bad advice. Never say you'll do something that you have no intention of doing because if your bluff is called now you've lost all credibility.
