We went under contract to purchase a house on January 10th, we are cash buyers, so we set the closing for February 1st (there were extenuating circumstances that made that date the right one for us). The seller accepted all the terms. Due diligence ended 1/25, so we pushed for all of our inspections to be completed by 1/17 so we could turn in any desired repairs. On the 17th we were able to send over our list. DD ended at 5 PM on the 25th, the agent sent over the signed DD agreement at 3 PM on the 25th. Now they had one week to complete the repairs.
One of the biggest issues was a leaking septic tank. The seller's agent asked for a recommendation for someone to repair or replace the septic, so we gave them a name. It needs to be replaced and relocated because it's too close to the house. The relocation might require new lines into the house, so the estimated replacement is $7K. There is also a termite issue that has to be treated and they were supposed to test the gas fireplace to ensure it works, but by the time they called around, it wouldn't have happened after closing. So we are holding back enough money to pay for the inspection ourselves and to buy new gas logs if needed. All of these things needed money to be held back at closing because they were not completed before (and were agreed to on the DD request).
So the seller's agent knew from the beginning and it's on text that we were closing at 10 AM yesterday. 10 AM. We get there and wait for almost 30 minutes for the seller and the seller's agent to arrive. Nope, they never planned to be there. Then the seller's agent started fighting holding money in escrow for the agreed upon repairs. Oh, and we are missing a window that they sent off for repairs. When my agent asked when we would would be getting the repaired window back he got all pissy with her and told her he'd let her know when he knew.
So here we are waiting for this agent to get back to us on EVERY. SINGLE. THING. At least 20 minutes for each item and he fought it every single step of the way.
We were working on a pre-closing agreement since our movers were waiting at the house at this point (we had them coming at 11:30 and our closing was scheduled at 10 AM). Then suddenly we were informed that the seller (an attorney) had prepared his own deed, without telling the closing attorney and it would be there by 4 PM that afternoon. We are still sitting in the attorney's office for our 10 AM closing...
Finally we get to the point 4 hours later that they are willing to escrow for the repairs and sign the escrow agreement. They agree to the HUD-1, also agreed to in text that it's acceptable, so we can sign on our side and get to the house where our movers have been waiting for over 2 hours even after we had rescheduled them.
Then while we are unpacking the truck the attorney's paralegal calls and says that the seller wants to change the HUD-1 and have the deed prep removed since the seller prepared his own deed. She told him it was for preparing the escrow agreement. The seller's agent had the actual nerve to tell her that we should split that with them. What the actual F????? I told her I'd walk over that $75. He wanted us to split the cost of the escrow agreement for the items then never finished before closing?
I've never dealt with a horrible agent like that. My agent was livid, as she should have been. Seller's agent was getting 3.6% and my agent was getting 2.6%.
I'd love to know how I can follow through on his lack of professionalism and for making us wait for 4 HOURS when he was totally aware of our closing date and time. And then he had the nerve to be a complete jerk to my agent, who was calm and cool through the whole thing.
And I'd love to know if they are going to bring my window back. It's on the repair receipt as having been sent off, but right now I have plastic covering where the window should be.
Sorry that happened to you. Were there clues that the seller would be this uncooperative?
Pretty much. I referred to him as passive aggressive. Everything took days instead of hours. We had a three week close, so the timelines were tight. Apparently only for us, they never seemed to feel like it was a rush at all.
We love the house. We'd been looking for months and this was THE ONE. We've purchased three previous homes and it's never been the disaster this one was. The sellers had no idea we loved the house and it had been on the market for a couple of months, but their choice of their lead in pic was part of the reason we never looked at it earlier.
Sorry, that happened to you. That sucks. I've had issues with closings in the past. Not closing when we were scheduled and finding out an hour before. That being said, hopefully you can put it in the past and enjoy your new home. Congrats!
sorry it happened. I do wonder who thought 7 days to complete the repairs noted was enough time.
I agree. We could never get repairs done that quickly. Especially a septic system. That requires all sorts of site plans, permits, engineering, etc. It's a 4-6 week process out here.
Sometimes the other party can be so irritating, one MUST stay focused. "Eyes on the Prize."
"We love the house. We'd been looking for months and this was THE ONE," but willing to walk over $75 is yielding to irritation over the goal.
Yeah, attorneys can be the very best clients. And, attorneys can be nightmares, as part of their training.
But, this house is "The One."
I agree with the others. The week between closing and request for the repairs was a very short timeframe.
Good gas fireplace specialists are booked through February.
Windows:
I know one window repair company that can turn windows in a week as a special expedited service, since they make the glass in their own shop.
Otherwise, the window guys are at the mercy of a vendor's schedule. The wholesale vendors often take 2-3 weeks.
I know two window guys who leave the window in place and come to the house to deliver glass, after receiving the package from a vendor.
And, apparently your seller selected one I have heard of who takes the window away and brings it back after receiving the glass package from a vendor and then installing the glass at their shop. That is not a service I would use.

They had almost 2 weeks for repairs, had they looked at and accepted the repairs request. It was sent to them on the 17th and they had until the 31st to complete the repairs. They chose to wait to sign the repairs request until the 25th, the day DD ended. I'm not sure how that's stacking the deck against myself. We were trying to give them as much time as possible. We also had absolutely no problem with the attorney holding money in escrow to pay for the repairs that wouldn't be completed until after closing. The sellers were the ones who were fighting putting the funds into escrow.
And yes, after 4 hours of sitting at the attorney's office while our movers were in the driveway of the house, I was giving into my frustration over $75.
