If the other party is LLC? Looks like per Chapter 38, attorney fees can only be recovered from individual or corporation. Has anyone heard of any cases that the attorney fees can be recovered from an LLC?

It depends on your contract. Out here it is in our contract that attorney fees are recoupable by the prevailing party.

to add to, not contradict in any way above, an LLC is a corporation. A Limited Liability Corporation.
