Hopefully, if you are done with the deal, you can get your earnest/deposit money back and find another house to purchase. If your attorney is right and there is a breach, is the builder willing to compensate you for your out of pocket costs plus something for your time?

They want you to use their lender because they get $$$ on the back end of the deal.

The Builder is just trying to shove him to their "Preferred Lender"

Probably part of the same company.
