I'm in SC and every post above is correct. We typically sit down with the buyer/seller/agents/attorney and review the HUD and sign off on everything after review. I think there is a lot of the story missing here. If the numbers don't match the contract then the seller should call the attorney that handled the closing. If the numbers are that important, one would think the seller would have caught it prior to since they were so in tune with what they were to receive.
The post doesn't add up to me. I think there is a lot of info left out so back to the help section...the seller should talk to the closing attorney. I don't see where the Realtor and lender did anything wrong necessarily. They may have, but there is nothing the OP posted to indicate it.
After the purchase and sale has been signed and terms agreed to by all parties and reviewed by counsel etc, the buyer's agent asks the seller if it is ok to raise the selling price by $3k so that the buyer can get closing costs from the bank promising it would no affect the proceeds to the seller. The seller agrees orally but not in writing -- as long as the proceeds received would not change--- only to find out after the closing and reviewing the HUD statement (and finding his bank account $3k short after proceeds of the sale have been transferred) that the sales price was not raised and the $3k was taken out of the sellers proceeds.
Can you IMAGINE? Does the seller have any recourse? I suppose not after the banksters and the stealtors together have plotted to rip-off the seller and make the deal go through for the buyer.
Correct me if I'm wrong, but in other words your question is basically:
"Can fraud-ster #1 sue fraud-ster #2 after fraud-ster #2 reneges on a deal he had with fraud-ster #1 to ripoff fraud-ster # 3?
We just closed on our property with title company,seller and buyer are dealt with separately and as stated,we as seller were read each line and asked if we agreed.Buyer dealt with separtely since might have some private info pertaining to job or mortgage.We then were brought back together to discuss and sign.
