No way it can be enforced? It already is. I don't know about Canada, but here in the States open marriage = adultery as far as the law is concerned. Consent is irrelevant. And our military still prosecutes military personnel for adultery regularly.

Actually, the term "marriage" itself in no way excludes a relationship between more than two people. Perhaps the biblical definition does, with the whole "cleave only unto the spouse" bit - but that's actually irrelevant since marriage is not a biblical creation, nor does the bible have any part in legislating marriage in this country as a legal institution. And yes, in this country, marriage is entirely a legal institution.

The fact that YOUR interpretation of the word marriage includes monogamy is why, by definition, "open marriage" is not actually an oxymoron. The word marriage itself does not inherently contain a requirement of monogamy.

Plenty of places in the world practice polygamy as a legally recognized and sanctioned style of marriage. Again indicating that the word "marriage" does not inherently include monogamy in the definition.

The law lags behind social progress. Adultery laws may still be on the books in some places, but rarely enforced (military excepted), and can probably be challenged based on more recent law. Interracial marriage used to be illegal, too - and those laws may still be on the books in some places.

Laws to coerce or criminalize personal behavior, when no-one is actually harmed and/or the people involved are all consenting adults, seem ridiculous. If you don't want to engage in a certain type of activity or relationship - don't! Trying to prevent others from making their own choices - restricting their civil liberties, essentially - seems fundamentally wrong.
