I read the posting asking the question about having sex with an escort legal or not. I did some legal research and found that sex with an escort in a context of social companionship is legal. Why do escort get busted for prostitution? (1) They solicit sex for pay when they meet their client. (2) They jump into the sex act without rendering social companionship. There must be evidence of social companionship before the legal defense of social companionship works.
If the escort watches a movies with a client or go on a dinner date and the escort have sex with the client after at least 60 minutes social companionship, it is legal according to court rulings. If it is not legal, there certainly a legal defense for all states in United States. The three court rulings that I list at the end of the posting can be used in any court in the United States. If the escort asks for more money for the sex act, then the social companionship defense will be weak. A true escort doesn’t ask for extra to have sex with a client and render social companionship before sex. A prostitute is a person who up front solicits sex for pay. There are many indoor prostitutes that uses escorting as a front for prostitution. Escorting and prostitution are two different things. Cowboys 4 Angels allow their male escort to have sex with their female client. Their business model is money up front, date, and no guarantee of sex. The news report states that they are legal in all the states they operate in. If sex happens, it is personal preference between consenting adults. Here are the court cases that legalize sex with escort in a context of a date. People v. Johnson, 376 N.E.2d 381, 17 Ill.Dec. 382, 60 Ill.App.3d 183 (1978)), Bergen v. Wood, 14 Cal.App.4th 854 (1993), and Commonwealth v. Potts, 460 A.2d 1127, 314 Pa.Super. 256 (1983).
With sugar babies (mistresses), it is legal in the United States. There are court ruling that legalizes mistress-lover relationship and exempt them from the prostitution statutes. There is a federal rule establish that cash and property from a lovers are gifts and not income. Many states’ prostitution statutes don’t criminalizes gifts for sex. This rule is found in the court ruling; UNITED STATES of America v. Lynnette HARRIS and Leigh Ann Conley 942 F.2d 1125. Here are the other court cases that legalizes mistress-lovers relationship; Commonwealth v. Stephanie Ann Danko, 421 A.2d 1165, 281 Pa.Super. 97 (1980), and Cherry v. Koch, 129 Misc. 2d 346, 491 N.Y.S.2d 934 (N.Y. Sup. Ct. 1985).
The case law speaks a unify message. You can pay someone for a relationship that include sex as long as the relationship is not specific sex acts. If you don't have companionship as a buffer, then paying for the sex act is considered prostitution.
OP, kudos on your legal research. but still doesn't prevent the woman and john/sd from being caught up in a sting, arrested, criminal proceedings, hiring an attorney, arguing the law, etc.
The reason why the Johns get arrested is that they solicit sex acts for pay. If they purchase the companionship package, they will not get into trouble. If they do, they have a legal defense. With escorts, they are in a catch-22. To attract male clients, they use code words on their ads. When the John laid money down on the table and the escort take off the clothes, it is prostitution. If they don't engage in raw prostitution, many male clients won't go for it. Many Johns don't want to go on a date or watch TV with the escort before sex. They want to jump into action. When that happens, there is no legal defense of social companionship. Do it right and you are dammed. Do it wrong, you are dammed. Not enough jobs in the US. Many are forced to go back because of the economy.
Escort services are wonderful. You can be ugly, boring, and socially retarded but have a 10/10 on speed dial.
