Default Divorce

ok maybe someone can help me.. If you are going though a divorce and you dont want the divorce and the other party keeps coming back to sleep with you.. does that make the divorce null and void? and they are to start over?

Legally, no. Sleeping with your STBX does not make the pending divorce null and void.

Unless it's in New York. New York is the only remaining "fault" state. If the divorce proceeding is brought on the ground of abandonment, having sex invalidates it. There was actually a famous case back in the 1990's of a couple that litigated their divorce (not property or custody issues, but the sole issue of the divorce itself) for 18 (YES, EIGHTEEN) years. Ten years into it, they were invited to the same party. They got drunk and had sex. Afterwards, they spent another 8 years in litigation, arguing whether that one instance of bumping uglies somehow canceled out more than a decade of living apart.

In Virginia, it's outlined in most property settlement agreements that having sex in no way stops divorce proceedings or renders a separation null and void.

In fact, once you sign a PSA in Virginia, if you want to get back together, you actually have to file for it!

Hopefully you are not trying to find out so you can use that as an excuse to stop the divorce?
