i've been thru all of this before in a rental. first, you need to write a letter to your landlord certified mail, stating the problem and how long it's been going on and that you want action taken immediately. call the county and have them send out someone to test it. just because it's mold and appears black does not make it black mold.
when you have proof that it is black mold, that you notified your landlord and he did nothing...then you have a case. you have to prove the mold was known by the owner and that he had ample time to take care of it but did not. otherwise, he is in no fault.
make sure you already have a paper trail. hence, the certified letters.
take lots of photos.
i suggest you try cleaning it with bleach instead of leaving it there in hopes of a case. your health comes first, right?
i hope this helped.
