Hopefully you filed a police report. Did you not let your landlord know how you could be reached while you were away? On the face of it it does sound like gross negligence on the part of the landlord and I'd suggest you seek an initial consultation with a good real estate attorney or your local Legal Aid office to see if you have a case. My landlord gave the keys to my neihbore without my permision while i was gone for 5 months. When i came back i had $ 4,250.00 of my property missing.There explanasion is that because they had to entered my apartment because of a gas leak and they did not have my keys they change the keys .
So now because they did not know what time i was coming back they gave the keys to the neihbore so i donot wake them up in case I was coming back in the middle of the night and because they thought i was good friends with neighbore. I want to sue him for neglizence because I cannot prove that they stole my property. Please help. I leave in Chicago Illinois
What does your lease say about the tenant leaving the premises for extented periods of time?
My lease states if I am going to be gone for more than 21 days in a row, I have to give them notice of where I'm going, contact info and when I'm coming back.
And what does your rental insurance agent say about this? You do have renters insurance, right?

Still none of that would entitle the landlord to give the keys to a neighbor unless they were a property manager employed by the landlord. With that kind of lo$$ I would definitly hire an attorney to sue for damages.

Oh I agree..and two wrongs never make a right..but I was just askin.
a friend of mine has this happen, little things would come up missing. so he told his wife and kid to leave for the day since he didnt have a car and they'd think no one was home........
so he sat there all day, and then low and behold about 6pm someone unlocked and eased in the door and he calmy cocked his gun and said "explain yourself in three seconds or you die"
the landlord had given a utility guy a key and he just decided to come over one day..........probably to steal whatever he could but was caught...
my friend has a CCW and it looked pretty bad when the police showed up...and of all people, the utility man called them

Do you have proof, that your landlord gave your keys to someone else? Did you report to the theft to the police? Your best bet is a police report saying your landlord gave your keys to the neighbor. If you get this yes you can sue and win. If this amount is above the SCC limit you might be better off just suing for the max and avoiding the lawyers fees.
If I had strange people coming into my apartment, I would call the police. Let the LL bail his/her friends out of jail and explain to a judge why her "boyfriend" was breaking and entering someone's apartment. I would bet it wouldn't happen again! Write a deman letter to your LL about the keys being in the hands of strangers, and ask for your locks to be changed at her expense. Then, print out a copy of ll tenant rights for your area. Read those. Is there an Apartment Association there, file a complaint, or find out who/where you can file a compliant. Put a nanny cam up, hide it. And take it to the police, and file charges!! Get some protection on your doors, some cheap alarms that ring really loud....even those might deter these lurkers that are coming in when you aren't home. This sounds scarey!! Do you have a big mean dog you could borrow?? Be safe.
