Hi,

I gave 30 days notice and my last day is nov 13th. Though my apartment is empty with minor stuff, i moved to different state and i gave the apartment keys to my friend to check my mail and to pick up the remaining stuff.

In the mean while my apartment management changed the carpet, painted, changed carpet and rented it to the new tenant from nov 8th.

I was expecting really important mails and lost some stuff that my friend is supposed to pick it.

Can you please suggest ?. I wanted to file a consumer complaint on management company. Any help is appreciated.

What did the notice you gave state exactly? Were you on a lease and moved out early or had the lease expired?

i am on month to month (not on lease) and i gave them 30 days notice on october 12th/13th so i have to move out of my apartment on nov 12th.

So you move out early, leave stuff behind that it seems your friend might not have dealt with as you two might have agreed to...and from the 8th to the 13th is 5 days.

I suggest you forget about it and move on with your new life....which I think might be just as screwed up as your past life if you hang on to the past (especially 5 days) and "friends" that do not deliver for you.

I've had something similar happen a couple times - I like to move early, so I don't have to rush, and I have plenty of time get everything moved, and clean the old place properly - and a couple of times my landlord has been so eager to get in, that they come in, while I still have lots of my belongings in the old place. Once it's clear you're sleeping at the new place, some landlords just can't help but come in, even if it's clear you're not totally out yet. One landlord even started to paint, while I still had boxes left to move - but he figured it would be okay, since everything was boxed up. And it was okay - although I would have preferred if he had asked first.

So yeah, if your apartment was essentially empty? And you had already left for another state? I can see why your landlord might have thought you were officially out, and gone in and painted and replaced the carpet.

Your important mail may be delayed, but if you put in a change of address form with the post office, you'll get it eventually. Sometimes it takes a few weeks - but you will get it.

Next time, if you move out early, but still want access until the end of your agreement, let the landlord know your plans. You legally have a right to the space until the agreement ends. But if the place is empty, and you're in another state, and if it looks like you're officially out, it's not that outrageous to think a landlord might enter the space and start to get it ready for the next tenant.

The post office offers a service to HOLD mail or to FORWARD mail.
In the future you should use that.
