What is my recourse here? He is forcing me to sign a lease.

give more details. are you on a month to month? what state. Do you pay rent on the 1st of the month?

when did he give the lease? what period does it start?

is 30 days notice required in your state?

are you thinking of moving instead of the new rent?

I heard some places rent is going up because a big demand for rentals.

nobody can force you to sign a lease. If you don't sign, your landlord would probably give you notice to move out. find out what the period of time between notice and move-out is in your state. are you ready to move if you dont sign the lease.

you could always try to negotiate the rent lower than what he wants. again, he might give you notice to move. who knows if he will or not. what did he say?

I was on an annual lease until Feb 15th. It automatically reverts to month-to-month.

Yes, I did pay my rent on 1st of every month.

He gave me the new lease on Feb 19th. We negotiated on the rent increase. But I have not signed the lease because I want the rent to be effective from March 20th which is technically the end of 30 days. I dont want to move out at least for a year because I want my kids to complete their elementary schooling in the current school district.

Did you mention this information that you want the increased rent to be effect starting on March 20 prorated for the rest of the month of March to begin new increase due April 1st? What did the Landlord say? I don't see the issue here unless Landlord wants the increase March 1st?

Did you tell him about the 30 day notice needed? Lease or no Lease I believe the 30 day rule still applies.

First of all, that S2000 and sware2cod for answering my question.

He wants to raise the rent retroactive along with the lease on Feb 16th. Then I mentioned to him about the 30 day notice and that the increased rent should take effect only on March 20th. Now he is saying that he wants the increased rent from March 5th(!!) - 15 day notice. I dont know what to do!!

what is your state rule, 30 or 15 days?

Also - are you splitting hairs about a small amt of money? If he raised by $150/month, then it is $75 different between Mar 5 and Mar 20. Is it worth arguing over? Especially if you negotiated the rent down from what he was trying to raise it to?

A landlord does not have the power to force you to sign a lease...

Proper Notice is required...

You have options... and your most powerful option is to choose to no longer do business with him and move.

There are many "New" landlords and many don't want to be landlords at all.

I find it helpful to cite and enclose the applicable law by mail to clear up any misunderstanding...

If he has erred... pointing this out will delay the increase a few weeks...
