Now let's move on to the definition of assault:

Note that one does not have to have any contact with the other for there to be an assault.
As for the 5 day notice: read the sticky at the top of this forum for your state's landlord tenant laws. If you wait for an eviction, chances are you will lose and, as others have said, you will then have a difficult time trying to rent. Leaving on your own is the best option for you.
