I decided to make this a separate thread.

I must leave my apartment by September 30 due to my recent " notice to quit".

But if, for example, I leave on August 15, will I have to pay rent through September 15?

Notice to quit? That's usually 3 days. Are you talking about notice to vacate?

Do you have a lease?

Why are you starting a new thread? Wondering if you already have your answers. Not enough info here.

Yes. You must give your own valid 30 day notice to leave before September 30 and not pay extra. Sometimes that notice isn't valid till the next month. For instance if you gave notice today it wouldn't be valid until the first of September.

If you're a month to month tenancy you must give written notice in accordance with your state laws. If you give notice properly then no you should not be liable for rent after you leave.

Find out your laws then mail your notice certified with return receipt.

Are you stating that even if I move out today, I must legally pay rent through August 31?

Correct. Or August 19th depending on your state laws.

You'll probably find your state laws linked in the first "sticky" on this forum and can determine from them whether they adhere to the calendar month or 30 day rule where notice is concerned.

You lease is up on Sept 30th. If you choose to leave before that date, you're breaking your lease early and must follow the guidelines in your lease for doing so. That means, giving proper notice ( 60 days in some states) and paying a penalty (two mths is standard, but consult your lease)

Kim, his lease expired a long time ago and he's on a month to month basis. I think that information is on another thread running concurrently with this one.
