I want to sue our landlord for nuisance, habitability and other stuff that is violating my rights.
The place is a noxious odor and fumes of paint. Every morning waking up I would either be sneezing or coughing out dark brown or gray flame. My wife, son and I experiencing that too but the lease is under my brother's name though we are living there. I can't take the place either cause it old, dirty, noisy too (I can hear my neighbors walking above me), infested with bugs which bits us and air is polluted in my unit.
The word is "phlegm". Flame would be pretty awesome though.
Do you have permission from the LL to live there off the lease? If not, you really don't have a right to be there. Good news is you can leave anytime. Sounds like the place has so many issues, most of which can't be fixed, that the only real option is to move.
Technically, your brother is your landlord and you are either legally subletting or illegally subletting. If you sue anyone, it would have to be your brother.

Some people are just sue happy. This will be funny to see another "defendant" win when a person with no right to sue will sue a landlord while the plaintiff is illegally staying at a place...
You're only option in this situation is to move. You aren't a legal tenant (I'm assuming ) so suing the landlord would be up to your brother and would probably end in an eviction for the whole lot of you.
