Is there anything written under the special provisions clause? And were you provided with the 5 days notification prior to the lease start of there being changes made to the lease? If not, seems pretty open and shut that they've violated the terms of the lease. The only out I see there is in paragraph 18, as it explicitly states their community policies are considered part of the lease and reasonable changes can be made so long as it doesn't affect the rent. So the big question is: are they charging you more for the 5BR or are they still giving you the price you had originally agreed to for the 4BR?

Ah; just saw your post. Glad you were able to get out of the situation so easily!

Congrats. BTW, what does TAA stand for? Tennessee Apartment Association? Texas Apartment Association? Tri-Valley Apartment Association? Tazmanian Alcoholics Anonymous?

Since the OP is in Texas, presumably the Texas Apartment Association.

Okay question, I signed a lease to rent an apartment but found out a day or so later that I was not approved and needed a co signer , me and the co signer go over to sign the paperwork and find that I was mistaken about the rent amount on the apartment .they are still trying to make me pay because of a binding contract even though my co signer didn't sign , which means basically I'm not approved alone . so am I still stuck in this binding contract if I'm not approved for the apartment on my own and my cosigner never signed for me ?

Default Similar but different situation

I signed a lease yesterday and it wasn't really what I wanted but I could do it. However my guarantor no longer is going to sign because they wanted me in a two bedroom instead of a four on off campus student apartments. I also did not put money down however I did sign the lease. I told them I did not have a guarantor today and they asked if I could find anyone else and I said no. They said they had to contact the property manager and they would call me tomorrow. Am I able to get out of this lease now that my guarantor who was also going to help me with rent because I'm a college student is not going to sign?
