I gave a deposit and I am supposed to move in on June 7th. I just found out that I cannot move to the apartment now. I have not signed the lease and I dont care about the deposit. I just want to now if they can come after me for anything else. I live in Dallas, TX

You didn't sign anything, so I wouldn't think they could do anything.


I'd be getting my money back though.

Me, too.

You don't have a signed contract, so they can't come after you for rent. IMO they also are not entitled to keep your deposit, unless part of it is designated as a holding fee.

if this 'deposit' was actually a holding fee, they wont' be getting their money back. The complex was holding the unit for the OP and the OP backed out...it wasn't like they weren't approved and the complex turned them down.

Exactly. If it was a security deposit it has to be returned to you but if it was accepted as a holding deposit the LL can legally retain it.

If you cancel after being fully approved and have not signed your lease your are out all fees paid to this point. It will state this on the back side of the TAA application.

had you signed a lease it could have been more.

Depending if it was holding money until move in..otherwise you should get it back. Application fee is different but due to people like you who for whatever reason change their minds we have made every security deposit a holding fee until move in and it is disclosed on our website and on a paper we have tenants sign when they give the money.

We got sick of having to inform owners that the tenants they expected to rent changed their mind.
