I went to court this morning for the eviction of one of my tenants. Her rent is $650 a month and she had fallen behind to the tune of $1350. Long story as to why I let it go so far. I had allowed her to make weekly payments then she lost her job and I waited patiently as she started to pay all sorts of odd amounts. When she finally stopped paying ANYTHING at the beginning of September I realized it was time to light a fire under her. Anyway that's irrelevant. Just trying to rationalize my bad landlord skills. lol
She brought $500 into court and I told the judge that was fine, and that I would gladly accept payment of the 850 remaining at say, $30 a week. He got out his calculator and said he didn't think I should have to spread it out over that long a time, and he asked her if she thought she could pay it all before December 31st. She said yes, and I agreed. She has been a good tenant apart from the lapses. And this solution to me, is still better than looking for another tenant.
He said he was also wanting to save me some time and effort, and didn't want me to have to bring her back into court with the 3 day notice, serving her, etc. So he told me that if I wasn't happy with how the payments were progressing, by the end of the year, all I'd have to do is go up to the Sheriff's office and get them to do the eviction.
My question is, (didn't think about this until I left the courthouse) if she defaults badly before the end of the year, (eg. in November) can I bring that same warrant of eviction forward, or will I have to do the whole thing from scratch again? I think it's the latter... but just wondered if anyone knew.

Call the clerk of the court and ask for clarification.
