Hello!

So we moved out of our apartment due to a severe roach infestation but through it all have a good friendship with LL, and have taken good care of this apartment. Gave 30 day notice. Moved out 10/12, returned actual keys and did walkthrough on 10/13. Contacted LL 4 days ago said she was still waiting on receipts from a last minute 2nd cleaning on the carpet and then she would send it by mail to our new address. Today is the 21st day (from returning keys) and I have not received anything by mail or an update on our return.


Ive researched this for weeks and I just cant seem to figure it out.... If she sends it within 21 days and i dont receive it til after, is the 21 day rule broken? Or does it NOT matter when I receive it if she mails it on time?


I just want to make sure I have my facts correct before I go demanding our full refund.

In CA, the LL must mail it or personally deliver it to you within 21 days. So, a postmark would be good enough.

Have you read you state's landlord/tenant handbook? I suggest you do so then you'll know what the time frame is.

What is allowed in one state may not be allowed in another...so read the laws pertaining to your state.

In most states, I believe the intention is that it be mailed by the xx day, rather than received. Some states could be different, but I would give it until tomorrow and then if you don't receive it, she is probably in violation. Most mail gets delivered next day or within 2 days, at least in my experience.
