Yes you can. It is not illegal to discriminate due to a misdemeanor charge.

You can also be denied for anything else on your application that looks unattractive to the landlord.

Try denying an applicant because the application says they have four kids.

My dad has 3 rentals he could deny because of kids and laugh the case right out of court. Blanket statements are bad.

I deny kids all the time...as well as pets. I only allow professional singles/couples in my apartment. Not illegal.

Are they all studio units? On what ground other than capacity and senior-age-restriction could one deny because of kids?

Do you have a high income standard? Do you deny kids in the tow of high-income professional applicants?

Do you deny applicants BECAUSE they have kids, or because of some other deficiency in their application?

As with any business the onus is on the Landlord to know the applicable laws.

I have very high income standards. I live on Long Island where my property taxes are over $18,000.00 a year. My tenant pays $1700 a month for a 1 bedroom.

I deny kids altogether...not just because of a deficiency in their application. My rent ads simply state...professionals only. No smoking, kids, or pets.
