I was a manager in Santa Clara. Unless she's in subsidized housing where she can only be evicted for-cause, the landlord has the right to give her a 60 day notice to move, which, if I understood your posts correctly is what happened.

If she doesn't move within 60 days, she can be evicted. If she's evicted, her chances of finding a decent apartment fall to nearly zero.

I'm a low-income senior, so I'm talking to you as someone who is basically an equal to your friend. If she doesn't have a car, and can't afford one - that's not your problem or anyone else's problem, other than hers. She is choosing to spend her money on something other than a car. I live on $890/month SSI income, and I have an old Nissan pickup. Other seniors here on the same income spend their money at the local casino or on cigarettes or the local bar or dining out. Her priorities regarding how she spends her money, and how that affects her transportation options are not your problem or reason for her to not find housing within 60 days.

My experience, too, with low-income seniors who don't manage their money well, is that they will also protest that they are victims and enlist others to help them, because of how evil their landlords are, etc. And it would appear that this friend has done this to you.

It's nice of you to care about them, and want to help them. But, just know that someone like me, with only $890/month income not only pays her own rent on time, but also affords to have a vehicle, and could afford to move if given 60 days notice.

So, put it in perspective, and my advice is - don't take on this person's problems because it sounds like they will willingly make their problems yours.

And take a minute to think about how much she makes and what she spends her money on.

I, at first, fell victim to other seniors who would cry about how they couldn't afford to get to their doctors appointments, etc., or to the store, etc., and would want a ride from me. Then, I'd realize that they make the exact same monthly income as me, or often more, but they chose to spend their money on the home shopping networks, or their "medical marijuana" or buying new clothes, or the casinos, or cigarettes, or the local bar, etc. And that they actually were asking me to subsidize the car they also wanted the benefit of having - but not paying for.

I was smart enough, finally, to stop supporting them. They sure weren't helping to support me.

And I think your "victim" friend is probably one of these types.

At any rate, the landlord has every right to give 60 days notice to terminate the rental agreement if she's not under current lease with a later termination date. And if she's not under a Section 8 or rent controlled housing situation.

So, I think you should wish her well, and not get involved. Because next thing you know, she'll be sleeping on your couch.

He hasn't given her a notice yet, but if he does, she'll be going to Legal Aid about the problem.

I'm also a low income senior. My SS is $722/month, but I also work, as do a lot of other seniors on SS. I have very cheap rent, ( I don't (and won't) live in subsidized housing but am looking for another place to live, and I'll be paying more, but since I work, I can afford it. I also have a Chevy Astrovan, which is paid for.

My friend isn't a senior citizen, she just turned 40, can't afford a car, and doesn't make that much money, it's not a matter of her not being able to manage it. If you work 40 hours per week on just above minimum wage, you don't have much to work with. So where did you get the idea that she was a senior citizen?

I used to live in the same complex, and know what it's like there. Unfortunately, some people have a hard time getting out of there. I'm getting involved because I know the situation there. No, she won't be sleeping on my couch, and no she's not a victim of bad money management. Only a victim of renting from a real estate agent/slumlord. This guy threatens tenants who ask for repairs with 60 day notices, and hope they move out so he can get new tenants that will pay more rent, and he likes to keep the property transient, because he doesn't refund deposits.

Would you like to live with rats, roaches, and mice, along with electrical and plumbing problems? I don't think so.

So what's the complaint your friend has to take to legal aid?

Did she make a complaint and the landlord came in to fix it immediately but didn't give her 24 hours notice?

You said the problem is that the landlord is coming in without proper notice to fix things. Now you're saying he isn't fixing things?

So what is the real issue here?

Slumlords don't come fix problems immediately. So, I'm not understanding the issue, other than a landlord not giving proper notice to enter.

If she complained about rats, and he came in to take care of the problem immediately without proper notice....then it's hard to make a case about a landlord who doesn't take care of rat problems, if you understand where I'm coming from here.

So, if that's going to be her approach with legal aid to keep from being kicked out with a proper 60 day notice - she won't win.

Your 'friend' is in a situation that no one here can help her with. You, however, can help her. What have YOU done to help this friend? Have you drive her around to look at places? Have you gone on your own? Have you offered to help her financially? If not, then you're part of the problem, not the solution. And no, I'm not being snarky, but it seem like you and your friend have every excuse in the book as to why you/she can't move

That's great that you used to live there, but that has no bearing on your friend's situation. None at all. Legal Aid won't care, the landlord won't care, building inspector won't care...so your file is just collecting dust. I'm assuming she lived there when you left because I can't imagine that you'd sit by and let your friend move into such a dump.


If the landlord is responding to repair requests or pest issues, there's nothing for your friend to complain about. Is it wrong for him to leave a mess when he leaves? Sure it is, but it's not illegal unless he's creating a safety hazard.


If he issued a legal notice to vacate, she has no choice but to move. How are you going to help your friend if this happens??


Your friend makes more money than you and yet cant afford to move? She must have a lot of debt or is horrible with money
