For an update the owner did not have no insurance neither did the renter, he kicked the lady off the property and the woman has been staying in hotels with no help from the owner the fire was not caused by the woman it was caused by a person that broke into the home while she was away...should the landlord be helping the woman?

But there has been a lot of negligence from both the lady and the landlord. And now the house is gone who is to blame now??? The house was in very poor condition, the landlord never made any repairs to the house, he left all repairs for the lady to take care of. She lived in the home for about 7 years. There was a time when the lady failed to pay her rent for a year or two (the lady is on section 8) and the landlord was only accepting the rent paid by section 8 he let that go on for a while before he finally brought it to the lady attention. The landlord hit the lady with a 4,000$ bill the lady then gave him her social security card where she received government funds and asked him to take all the money that is deposited for her disability In the total of 900$ Is deposited on that card every month from the government.
That’s just a brief over view of what was going on.

Should not matter. In the end, the homeowner is responsible because he/she is the one who can get that house insured and protected by an insurance company.

If it's tenant's negligence, they can/will be held responsible; either the owner or the ins can/will go after said tenant.

The owner is responsible for his own building. The renter is responsible for their personal property. That is why renters should have renters insurance, which is very inexpensive.
The lady should continue working with the assistance agencies and ask on the 211 for an attorney/agency that can work with her legal issues. Most cases a person on disability is judgment proof. And, it doesn't sound like this LL followed the legal system to collect what he says she owes. It sounds like the lady voluntarily gave him funds. This LL could be committing a serious error by collecting this money from this lady.....it could possibly be considered abuse because disabled folks are protected from those that may take advantage of them. The lady/renter does need to get some help to resolve this asap. She should call 211, and/or speak to her casemanager and tell what this LL is doing with her funds...Someone will be able to help her.
Keep us updated. There are agencies that help disabled and/or elderly with these type issues. Ask 211 for the local contact information for this lady. Good luck
The history of rent payment or lack thereof is irrelevant to this conversation. The owner could sue the tenant for back rent, but that is separate from this discussion.
The owner is responsible for the owner's loss. The tenant is responsible for the tenant's loss. The owner could choose to sue the tenant, and then the courts would determine whether the tenant could be held liable, such as if the tenant had left the house unlocked, or given someone else a key, and that person burned the house down. If the damage was done by someone who actually broke in, most likely, the courts would find that to be no fault, and thus say that the tenant is responsible for their own expenses and the owner is responsible for their own expenses. If both parties didn't have insurance, that was the choice they made.
