In my lease, which I just gave my 60-day notice of terminating the 2-year lease, it states that with reasonable notice, he has access to do showings.
That's all it says.
My husband and I both work full time with 2 younger children and a dog (that isn't too friendly). I understand that if they give 24 hours notice, I really can't say no.
However, since it doesn't say it...I am taking it that I can be present in the building and they can't make me leave??????.
Also, do I have any say to put my foot down on a time? I have two childrne that go to bed at 8PM for school the next day, so I plan on refusing any later showings.
I don't know what to do while I'm in work if they want to have showings...and then I have the dog there...I guess lock him in a bedroom and they don't have access to it??
I believe that the land lord has a right to show the place at any time that is reasonable, such as between 10 am and 4pm. I am not sure of your 'right' to state the time as it is going to be a time that is convenient to the potential renter and land lord.
I live in Minneapolis and put in my 60 day notice. They can show your apartment with the required 24 hour notice (that's pretty standard everywhere) and during the hours in which the rental office is open.
My rental office is open seven days a week from 8:30am to 5pm and from 6pm to 10pm. They try not to schedule showings after 8pm. I explained that, with the appropriate 24 hour notice, they can show my apartment no later than 7pm.
So, you can say if a time is too late or too early for you. As a matter of fact, they're showing my unit tomorrow night sometime between 6-6:30. I just hope it rents so they can STOP showing it!
I'd reckon that your landlord will want to be accomodating with you on times.
The likelihood is high however that you will not be around when the place is shown. Be sure to lock the dog in the bedroom before you go, or garage if thats feasible.
Buy a large dog "crate" Its bigger than a carrier and made to collapse when moving. That way he cant run out or bite anyone. He should have full room to stand up fully and enough room to lay down and move around a bit. (3-5 dogs wide)
They cant make you leave. Its your apartment.
No showings after 8 is a reasonable request I think. People can use thier day off to be there earlier. Its already dark and the time when everyone is usually already home.
Theres no reason to show up later.
You catch more flies with honey than with vinegar, I'd try to politely work things out with the landlord regarding times, "Is there any way we can try to schedule showings before 8PM, just because my kids will be asleep, I'd appreciate it!".
I had a nasty situation with this years ago. It was an apt. complex, and they insisted on showing, especially on weekends and evenings. They opened the door to the bathroom while my son was in there, also the bedroom while my son was sleeping...I finally told them "Fine, show it when you want, but we are nudists and I can't guarantee we won't all be runing around naked"!!!

A reasonable time would be during business hours (say 9-6 or so) with 24 hours notice - anything that deviates from this would be stretching it. You could ask them if they will pay for a "doggy babysitter" or a dog walker who can take the dog while it's being showed so you won't have to be concerned with the dog during the day. You don't have to lock the dog up - locking the dog up... I wouldn't never ask a tenant to do that unless it was only during the showing (so, for 10 minutes he's in a room or crate).
I agree w/ newtoli, "you can catch more flies w/ honey than vinegar" approach. I think most landlords will try to work with you if you make your concerns known (which are legitimate so I don't see them refusing you) as long as you don't go ballistic on them.
Yes. Be nice. Most landlords do accomodate time constraints as long as YOU are willing to work with them, too.
And yes, be honey, not vinegar. They still have to mail your deposit back to you and being vinegar could cause them to find little reasons to think something wasn't quite clean enough and take it out of your deposit!
