I was living in a third floor walk up apartment and after my second year there (lease had moved to month to month) I came down with Lyme disease which made it excruciating to walk up the steps. I am on disability through my employer. I alerted my landlord I was moving to a first floor in another state. They demanded i give 60 days notice. After I moved out (27 days after written notice) they told me I left things behind and would be taking my deposit due to this and only giving 30 days notice. i told them I would be back with someone hired to take things out because I cannot do the steps anymore. Not only are my knees bad, I get dizzy and black out due to the lyme especially doing physical things like stairs. (Also, the stairs closet to my apt do not have a handrail and I have fallen due to losing my balance and having nothing to hold.) They agreed to allow me to get my stuff. The next day (28 days after notice) I was told they threw out my stuff and changed the locks. Re: disability am I protected under FHA? It also seems P.A. Act 129 comes into play regarding disposal of my property after I said I would retrieve it.

Most likely, under the terms of your lease, there is no termination clause if the tenant becomes disabled and is eligible for disability. If no such clause is contained in your lease, the tenant cannot terminate penalty free. the terms of the lease stand for the most part .

i can't say for sure but it does not seem to mean much in most states .you agreed to the lease terms. if it was allowed every senior could break a lease with some excuse. usually protection applies when you need to go in to a nursing home in many states . you may want to check your local laws ..

eventually illness (which may cause what we perceive as a disability ) ----job loss and divorce hit almost all of us at some point. these things are called life and eventually hit almost all tenants . leases generally protect the landlord from having every tenant able to break a lease just because one of the 3 strike.

Exactly, but last I checked SSA is depleted by 2034 according to your government. (Hint: It will be depleted before that)

it will be funded in the 11th hour as all our problems are handled . ssdi already went belly up and required a transfusion . it ran out of money a year or 2 ago and had dollars diverted from ss retirement .

i don't give a second thought to ss going broke , it will be fully funded at the last hour . that is the american way of dealing with things .

but ss is not the scope of this discussion .
