Fortunate for your brother, they listened and stopped doing it. A lot of neighbors don't want to listen about a neighbor complaining to them about anything......and they just keep on doing it. We talked to our neighbors above us about all the noise they make, they listened to us and said "we hear noise from our neighbor above us so you will just have to handle our noise" and she shut the door in our face. Management won't do anything because these are so-called "family type apartments". No consideration for us from either upstairs neighbor or Management!! Don't EVER want to live in another apartment again!!

Hey Love-You do know that you can sue them in small claims court right? You can also include the mgnt company as well. In FL (as I believe in every state but can only vouch for FL) they have "a right to quiet enjoyment of unit" law. There have been people that have sued their neighbors whether it be a condo or house and have won with full proof of noise up to $5k! There's nothing like a little court action involved getting them to stop!
I do this on purpose, LOL. Quite the opposite situation though. The people below me are extremely rude, who are out on the balcony talking loudly at all hours of the night. They smoke out there, too, and if my windows are open, my entire apartment smells awful! Plus, they have surround sound speakers attached to the ceiling so I live with noise and vibrations every day. I have complained twice (after speaking with them) and nothing changed. So, I make a mess on purpose when I water my plants. Their balcony gets wet when it rains, so I don't see an issue. I make sure I don't water THEM, but I have no problem getting their balcony wet. They have their dog carrier and a plant out there, so I am not ruining anything either.

No, it IS an issue. I understand why you're doing it so I'm not criticizing that, but just because rain can get on something does not mean the neighbor upstairs has to be rude and destroy things. Their plant water actually killed my gorgeous sage plant, got a mat of mine moldy in one spot (it was in further from the area that would be hit from rain), and, I am entitled to use my terrace without water coming from the people above.

Your are right in what you say, but if the people have children its a differrent ball game.... Fair Housing Laws in every state protect the right of the child, check it out you will be very surprised.
Actually it doesn't. My brother had major problems with a tenants living next door (these were private condos) and the family had 3 kids under the age of 7 living there on all tile. The HOA law stated no more than 2 children under the age of 16 may reside there. It was the wife's mothers condo so they were basically renting. My brother wrote dozens and dozens of letters to the HOA and spoke to them (HOA and tenants) personally numerous times. (I did the same but I was not a nice person) I told my brother numerous times to sue the neighbors but he wanted to be a nice guy however, not sleeping and being woken up during the day (hes a firefighter) due to the fact that the mother didn't utilize a park next door but their condo as a run around area. Anyways, they finally moved but Im talking about 5 years of total torture. In FL, you are not supposed to have more than 4 people living in a 2/2 apt/condo.
4 people well that could be 1 adult & 3 kids.... If you want to live in all adults comm do....but I remember a case a few years ago where this boy about 14 at the time lost his parents He went to live with grandparents the whole comm was in an up roar 1/2 wanted them to move or get rid of thr kid the other 1/2 did not care!! The LAW decided they could stay because HMO have no right keeping kids out!

Actually it does, here's an exerpt from it...... "Federal and state fair housing laws expressly require apartment dwellers to put up with normal, reasonable noise from children. This noise would clearly include noise made by children while playing in an apartment, provided that their conduct isn’t overtly unreasonable (e.g. jumping off their beds at 1 a.m., or playing the stereo on high late at night) . The manager cannot evict you if your kids have been making normal noises while playing inside your apartment, such as laughing, giggling, or rolling on the floor. To do so is illegal. The law does NOT make another tenant’s desire for peace and quiet paramount to your children's right to play in their apartment. To the contrary, the law expressly states that a desire for peace and quiet is NOT grounds for making rules against children. Children make noise. That’s part of being a kid. The law requires landlords and tenants to put up with such noises. This would include allowing kids to play around inside their apartment at reasonable hours even if another tenant complains."
I just moved out of an apt the is for elderly/handicap only.... My ex-neighbors 10 yr old grandson lives there with her.... Tho go figure my son thats 34 could not live with me... Both her & I had doctors written statements that we could no longer live alone... go figure!!
