We live here and pay rent ALSO, so that means (to us anyway) having a 2 yr old is NOT an excuse for all the noise the parents and their child makes. It is not our fault that complexes don't build playgrounds within them like they use to. We have a pool here, take the child to the pool and play in the water with her.......there are things that could be done to "tire out" the child so there wouldn't be so much noise made by her. AND, the father knows that he has his work boots on and still he runs across the floor chasing the child.
Yes, we are an older couple (60) and we do like some/more quietness than some folks do. We are not grandparents, so we are not around little kids that much. And, on top of that, I've had a hip replacement done and my doctor/surgeon does not recommend me using stairs to get to an apartment. Even when we look for another house to buy, we will be getting a "ranch style" due to my hip.

It sounds like apartment living in general might not be for you; at the very least be sure to get an upstairs unit in the future & buy a good pair of ear plugs b/c you are obviously very noise sensitive. I say this as a childless professional who has rented for over a decade.

EXCUSE ME!!! But you complained about a blender early in the morning, which is COMPLETELY NORMAL morning noise. If that is what you are complaining about you have problems. BTW I get up EARLIER than 5AM to get ready to commute for work and <gasp> I've been known to make my breakfast drink in a blender b/c I have to <gasp> live. And the guy upstairs from me works unusual hours so I have to hear him walking around with <gasp> shoes on over my bedroom while I'm trying to sleep. <Gasp> I had to get used to it b/c I live below him - How inconsiderate of him to wear shoes in his own home after 10PM...the nerve!!! Next thing you know he'll expect to have breakfast in the morning or get phone calls past 9 PM! Hell the guy below me had a snoring problem - that actually woke me up - I should've called the cops on him daring to try to sleep with an obvious apnea problem.
Bottom line you complained about a blender in the AM - your expectations are unreasonable. You posted on a forum for advice - I've lived as a professional in apartments for over 10 years - your listed expectation was unreasonable. The man wasn't throwing a party at midnight on a Tuesday, he put his blender on in the morning to make breakfast.

That's fine but you live with extra noise if you live in an apartment. To expect a 2 year old to live up to developmentally inappropriate expectations b/c you don't have the patience to tolerate something is not their fault either. Its just the nature of the beast - apartment living that is. You have to tolerate hearing other people's normal living noises. If you can't then you have to adjust the only thing controllable which is your reaction OR the environment you live. Expecting a 2 year old not to move around or do it super quiet is just not possible. And you really expect someone to revolve their life around tiring the toddler out so they don't move when they are inside? That is not practical. Also people wear shoes at home - you may have to invest in ear plugs if it bothers you that much. I have to get up very early and the guy upstairs works unusual hours. He wears cowboy boots (real ones) EVERY DAY & his bedroom is above mine. Guess what noise I've had to learn to adjust to? Let's just say it is quite a rude awakening. But I would never DREAM of asking him not to wear shoes - I would've never even THOUGHT of it until I read it here. He was participating in a normal activity & I living in closer quarters to him needed to adjust. That is life. Now if he threw a party or blasted heavy metal music at 2 AM every day - I'd be fit to be tied b/c that is not normal.

As stated many times in this Thread........normal noise is understandable, but a loud noise that goes on DOESN'T have to!! A lot of people just don't care who lives below them!! We won't run our vaccum until after 9AM b/c the 2 yr old might still be asleep......that is consideration, something our above neighbors don't have (or care about) and a number of apartment tenants don't have (or care about)!!
And, yes, when people are living in apartments, they have got some restrictions that homeowners don't have.........a big one is CONTROLLING the noise they make!!!!

Chances are the 2 year old isn't asleep around 9 AM so vacuum away. And if she was & you decided to vacuum at 8 AM (not 2 AM) but 8AM they have no room to complain.
Regardless dealing with normal living noises is to be expected. To expect some to curb their dietary, sleep and a baby's cognitive development is out of line which has been suggested in this thread. Hey I got to live next to someone once who had newborn twins with colic - talk about a treat! What should I have told them? Put the babies back?? Leave. Drug the infants? Its life - if I live in an apartment I have to expect there will be a certain amount of residual noise that I wouldn't have if I lived in a private home. Trying to change the unchangeable is an exercise in insanity.

Ok, ok, ok..........you don't live here and WE DO, so enough said!! If we don't like the loud noise they are making, we don't like it! As said before (again), they know we live below them and they just don't care how much noise they make. There are plenty of people in this Thread that have agreed with our feelings. If you don't, that is fine.......just put up with the noise you hear! Just how times do I have to say it in this Thread, the difference between living in an apartment and living in a house: Apartments are NOT playgrounds especially when "playing" noise gets so loud it annoys neighbors. A lot of people on this Thread would love to have neighbors (past/present) respect them when it comes to loud noise in apartments (but most of the time it doesn't happen). As far as baby's/children crying due to an ailment, that would have to be tolerable, but it wouldn't be continuing for days and weeks on end.
As far as using earplugs......why should we have to, they are making the loud noise we aren't. If they would just consider us, below them, and stop their 2 yr old from running, stomping, jumping up and down so much (just heard another "BOOM" from above me, sounded like thunder and now she is kicking a wall with her feet), there would be no problems!!! Gee, when I was 2 yrs old, I really wish I had parents that let me do whatever I wanted to!!!!!!!!!!!!!!!!

Loveboating have you had management come over to listen to the noise themselves? If it is as ongoing as you say, they should be able to come over and hear it for themselves. If they refuse, complain to their corporate offices. It isn't a huge request to have them come in your apt and hear what you are hearing. If they still do nothing after that, then complain in writing to their corporate offices.
When I worked in apts. I constantly had to go somewhere to hear offending music, blenders etc... If management doesn't hear it for themselves they will never believe you.

We did tell management here about the noise and all they will do is write the people a letter about the noise (in which they did), but that is all they are willing to do. They tell us that this is a "family" apartment home complex and there will be noise. One morning the 2 year olds father was home by himself and he decided to turn his stereo up so loud that I could hear music (Boom, Boom-Boom thru our ceiling. I went to the front office and told them about it and they said they would give them a letter about the noise. I said, "so what am I suppose to do about the noise right now?" No response, other than "we will give them a letter." I told them later to "forget it" b/c as soon as our lease is up we will be gone (or fairly quickly after it is up). We just don't want this to turn into a legal matter since they think they have every right to make all the noise and could do something legal against us......which we don't need or want.

I wouldn't think they could do anything to you. You are not breaking any rules what can they sue you for?
For management to do anything drastic, they have to show a written record of lease violations, if the noise is bothering you that bad you need to keep complaining if you want anything done, even taking it up the ladder to corporate. Usually when a tenant mentions the magical word corporate office, stuff magically gets done. Insist they come listen for themselves. Make them work for their money.

A) I highly doubt you remember exactly how you behaved as a 2 year old.
B) I have lived in apartments for over a decade.
C) My point is the noises you are complaining about are normal living noises - so my suggestion control the controllable which is your reaction. Two - year olds are loud (babies get colic for weeks - sometimes months), people walk in shoes etc. It is life and much different then loud parties or unreasonable noise. I disagree with making unreasonable amounts of noise; what you are complaining about IS the type of normal living noise which someone living in an apartment should expect to have to deal with.
