I moved into this apartment with roommates who already weren't the original tenants. They moved out already and I have 1 new rommate. The original tenant disappeared, is unreachable. Is there anyway I can change the name on the contract without raising rent since it's a 9 year old contract? If I move out will I get any deposit back? I'm lost!!!!

Is subleting allowed? If your name isnt on a lease you dont have anything to prove you made a deposit. So getting it back isnt something you should count on. Raising the rent is up the the landlord. If its rent controled he can only raise it a certain percentage as stated. Otherwise he/she can raise it as much as they want to.

If the landlord is not aware you are living there, then he isn't the one you paid a deposit to, so he doesn't owe you it back. He will send any deposit he was given to the original depositor, not you.

If the lease does not allow subletting, he can evict you at any time, possibly without notice via trespassing laws, depending on where you're at.

Your best bet is to either a) come clean and take the higher rent hit or b) take a chance you'll be homeless overnight. Hope you never have any maintenance issues too.

I wouldn't keep anything irreplaceable in that apartment.

Sounds like a scam & you got in the middle. I would contact the landlord/owner.......
He might offer you a lease for the same amount If you are honest with him.

Thanks all of you for the advice!!!! They were all very usefull. I'll find out about subletting. I guess it is alowed because the landlord knows all about us, except for the fact that we have no idea where the original tenant is...
