Deposit check not cashed (apartment, leasing, evicted, credit)

I am renting an apartment and have been here for 2 months now. I wrote a check for the deposit 2 months ago and it still has not been cashed. I talked to the leasing manager last month about it and he said that they deposit at certain times of the month. Well it's a month later and still nothing. What will happen if they don't cash it? I think it's their responsibility to stay on top of those things. Should I ask again?

I would ask again. I live in a complex that is managed by a large corp and I can imagine something would be easily lost.

I would just call the bank and cancel the old check before writing a new one.

If they lost the check and you have to cancel the old one and write a new one, be sure to deduct for the cancelled check fee your bank will charge you.

You gave them the check, it is their duty to deposit it in an account with your name on it ( and their name on it ) ( NJ law ) Also they must inform you in writing within 30 days, where your deposit is being held, or you can use that money for rent. If they lost the check THEY should have informed you in writing.

Of course, if this wasn't in NJ, that doesn't necessarily apply. In some states, following that advice could get someone evicted.

As an assistant manager of an apartment community I honestly have to say that is absurd. I have never heard of that in my life (I do all the banking). I would definatly stay on top of that, they may have lost your check.

Even better news, BofA does not take the money the day the check is sent, they give you from one to four days lead time before removing the money. One day if it's electronicly transferred, four if they mail the payment....

Actually thats not true. They can sit on the check as long as they want up until the check expires. (usually 90 days). In the meantime, you've had funds taken out of your account, for a check that hasnt cleared, and your losing any potential interest which you would have accrued until that check is cashed. There is a reason online banking is "free" to most, the reason is, its not free, there just isnt any fees. Lost of interest though is a cost that many dont associate with their online banking.

Once 90 days have passed (if its 90 days), and the check hasnt been cashed, your funds just get credited back to your account, the whole time, you assumed the receiver received their payment because funds were removed. Its happened to me recently, annoyed the hell out of me because I thought the receiver cashed their check but it got lost in the mail and they never received it. The person I paid thought I was a dead beat, didnt pay my bills and they wrote it off. I only found out when funds were credited back to my account.

I'm not sure I'd bother, but if you do ask again, submit the letter in writing, keep a copy of the letter, and send it with a delivery confirmation so they cant later claim they didnt receive an inquiry..
