I am so bummed. Been in the apt since July and have had no problems at all. But my lower neighbors were in and out. Then they moved and then we had none for a month. Was great.

This is the first time I haved lived in an apt. so I am new to all this, but I am not stupid. As an upper renter, I am very aware of noise level to my lower neighbors so I tiptoe, and make my daughter do the same. I do not run any machines after 7 or 8 pm and keep the tv low.

In comes new neighbors downstairs. I guess it is a family, I can't quite tell who or how many live there. But...they smoke on their patio and it wafts up into my windows. Ugh. Now, I know they have this right and I give them credit for smoking outside, but what a drag.


Just a small vent and a little note to people looking to rent apts. Beware of that possibility.

I bet they toss the cigarette butts all over the ground too. If I were you I would move to a building that does not rent to smokers. Don't feel like you're the only one with neighbor troubles. My wife and I are in a seedy apartment and we are surrounded by junkies tweekers and thieves. We sleep with a loaded gun. The cops are called to our building several times per week and there has been many serious beatings over drugs in our neighborhood in the last two weeks. Nobody ever seems to go to jail. I hope things work out OK for you.

Next time it happens just yell out your window: Hey thats coming up in my apt!
You could even set off thesmoke alarm if you want full effect.

I hate it when people will smoke outside thier home for themselves...RIGHT UNDER SOMEONE ELSES WINDOW.....

Tell your landlord,, and say that your daughter has asthma and the smoke is a bother and rises up to your place. If they are reasonable ppl they shouldn't have a problem.. I guess they smoke outside so their place won't smell like an ashtray.. well they should have the same consideration for you and not make your place smell like one either!

My Mom has the same problem. She's on 3rd floor and new neighbors moved into the 2nd who smoke on their balcony. On the nice days she can't open her window or balconey door for fresh air. Unfortunatly, there are no "no smoking" rules for the complex.

I'm not a smoker anymore, but most smokers would say, "So just where do you want us to smoke??? Go out by the carports or garages to have a smoke......I don't think so! Go out into the walkway and have a smoke? Then you will complain about smoke going into your apartment from that direction! We don't want our apartment selling like smoke......any suggestions?? Sorry, but we love smoking and as long as the Complex has no "no smoking" signs around, we WILL smoke!"
As I stated, I'm not a smoker anymore and wife and I won't make friends with people who do smoke or be around people who smoke, BUT, smokers do have the right to smoke if they do desire to. Just a FACT!!
Boy, if we could only "pick" the type of people we wanted to live around us, apartment living would be so much nicer!!!!!!!!

I do agree with you which is why it makes it so much harder to complain. They are smoking outside, so...it just so happens it rises. I was thinking the other day that they should only rent upper units to smokers. But then there would be many that would lie and say they don't smoke because uppers are usually more expensive.

Or maybe put some picnic tables in a grassy area with butt receptacles around. I mean this is Vegas, it doesn't really get that cold.

The people do seem nice but with no smoking policy in effect, I think it really becomes my problem. I did put a fan in the window blowing air out and that did help. I just wish when they smoked they wouldn't do the hand off thing and just all smoke at the same time. I can deal with the smoke anywhere but in my house.

So, complain about something your neighbors are doing that they are allowed to do, and also lie about it on top of it? Look, non-smokers have pushed smokers out and away of nearly every place they used to be allowed to smoke. Cut them a break, they aren't criminals!

If you don't want the smoke coming into your house, SHUT YOUR WINDOW. It's as simple as that. They are outside, and they have a perfect right to use their outdoor space in the manner they wish as long as they're not breaking any rules of the apartments.

And no, I am not and have never been a smoker.

Wow. No need to be nasty, noone else was. Apparently you did not read my OP. I think I was pretty fair in saying that it is a bummer. I did not say I was going to go complain to the mgmt. In fact, I said that I understand and give them credit for smoking outside. I KNOW that I can close my window-DUH. It is just a drag when it finally gets nice enough to be able to open them for some fresh air and that is what you get.

I also said that it was a minor vent and a heads up for people looking to rent, that they may not think of that.

Oh, and btw, my daughter DOES have asthma-so it would not have been a lie. The poster did not know this, just a shot in the dark.

And, yes I do enjoy a cig here and there, mostly if I go out-just never in my home or anyone elses.
