I would definitely check with my lawyer first just to have an idea of all of your liability and potential exposure.

Bad idea. He can start eviction. It's inconsequential that you pay rent in time and are quiet. You're supposed to pay rent on time and not behave like a animal. Living within the rules of the lease doesn't give you special privileges. I'm sorry you are having your lease terminated but the LL "having something against you" means nothing. You're withholding rent because he us terminating your lease and he has something against you? Good luck arguing that in court.

As far as the LL not giving you the deposit back he can only keep the deposit (whole/portion) only under certain circumstances. You not paying rent is one. He has to give you either a 30 or 60 day notice depending on how long you lived there. He also has 21 days after your last occupancy date/whatever date termination falls on, to return the deposit or send itemized letter as to why he is withholding all or part of the deposit. Now since you withheld rent you have absolutely no leg to stand on.
