My husband lost his job in Feb,had no job prospects or income of any kind we had a little savings but it wasn't going to last, we knew we could no longer afford to stay in that house. he found a ok job in Az so we moved we talked to the management company right away and told them the situation when we knew we were moving we gave notice and paid , we were breaking the lease and i knew there would be penelties so i asked they said we will send a letter.

I emailed for updates and status on the house, thinking for some reason they were going to rerent it. We are barely making ends meet at this point and last friday I finally got notice they are charging me rent to the end of the lease Dec 2009 which totals 8400. I explained we didn't have it and could we find someone else to rent and the reply is you signed a contract not our problem he lost his job. I am tryng to work with them because really it makes no sense for the house to sit empty and them to come after me when there is no money for them to get. This is a losing situation for both parties.

I am wondering if there is something I can do to make them see that is beneficial for both of us to get the house rerented, I understand I broke a contract and have to pay fees and am willing to do that but it seems excessive to charge me all the way until decemeber and have the house sit empty. Is there anything I can do?

i believe that they have to try to rent the house.. it could be just put a sign in the window... if it doesn't get rented, you owe the money.. sorry

You need a lawyer to write a letter. It is your problem that you broke the lease. But they must do their best to mitigate the damage.

They know this if it is a property management firm. You just need your lawyer to remind them that you don't have to pay if they failed to try and rent the place.

Normal practice is that such things are generally settled for a month or twos rent. They can try to nail you for the whole bill but they will have to demonstrate that they tried and could not rent it.

Please follow the posters advice to get a lawyer, they can easily do a wage attachment if they really want their money.

This is correct from my knowledge. A judge would not let the management company gouge you for rent until December if they rented the place in July.

Don't let them bully you. See an attorney asap.

thank you for all your help now the process of finding a lawyer any suggestions on where to look? I have never had problems before, and I really don't know anyone to ask I know i canlook online and get names and firms that way but didn't know if there was somewhere that could give a little guidance in what to look for. Thank you

A family attorney will probably be able to help you. Do you have any friends, relatives, neighbors or coworkers who may be able to give you a referral?

Or go to the City Data state forum and ask our lovely members for a family attorney referral in your area. Tell them you have a rental problem and I bet you get more than a few responses.
