I recently signed a lease and paid the security deposit and first months rent. Doing due diligence on the management company after signing the lease I discovered a large number of people who said that the management company extorted large amounts of money upon moving out through heft up move out fees as well as not returning the security deposit within 21 days of the termination of lease. These individuals also claim that they were assessed further charges on top of the security deposit even though they had done inspections and walk through with the management company upon their departure. There is a laundry list of other complaints from numerous people so it seems that these are valid problems and a nightmare of a place to live. Can I get out of my lease since I have not moved in yet, received keys, etc? Any thoughts or suggestions?
Depends on the state law, even at that, your looking at a time frame.
Anything beyond that, your in the wrong. Don't let another tenants
past experience lead you to court.
Advocating for yourself as a renter, knowing the landlord tenants code
for your state, are your best protection. Of course, you need proof of
anything in dispute, pictures, videos work best.
If the tenants aren't willing to file in small claims court, the LL won.
Exposing the LL is the best remedy, judges get sick of repeated
offender landlords.
